Acceptable Use Policy

Effective date: [EFFECTIVE DATE]

1. Purpose

This Acceptable Use Policy (“AUP”) defines the standards of conduct that apply to everyone who uses the Portfol.io platform — including educators, students, and visitors. It exists to protect our community, comply with applicable law, and satisfy the requirements of our payment and infrastructure partners.

By creating an account or using any part of the Platform, you agree to this AUP in addition to our Terms of Service. Violations may result in content removal, account suspension, or permanent termination.

2. Prohibited Content and Conduct

You may not use Portfol.io to upload, stream, broadcast, sell, promote, link to, or otherwise distribute content or services that involve:

Sexual and Adult Content

  • Pornography or sexually explicit material.
  • Nudity presented for sexual gratification.
  • Escort services, sexual solicitation, or sex trafficking.
  • Sexual content involving minors (child sexual abuse material — CSAM) in any form. We report all detected CSAM to the National Center for Missing and Exploited Children (NCMEC) and cooperate fully with law enforcement.

Intellectual Property Violations

  • Content that infringes the copyright, trademark, trade secret, or other intellectual property rights of any person or entity.
  • Pirated software, media, or other copyrighted works.
  • Unauthorized use of third-party trademarks or branding in a way likely to cause consumer confusion.

Hate, Harassment, and Violence

  • Hate speech targeting individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics.
  • Content that glorifies, promotes, or incites violence against people or groups.
  • Violent extremism, terrorism, or content produced by or in support of designated terrorist organizations.
  • Harassment, intimidation, stalking, or threats directed at any individual or group.
  • Doxxing — publishing private identifying information about another person without their consent.

Fraud and Deceptive Practices

  • Fraud, scams, or misleading claims designed to deceive students, creators, or third parties.
  • Phishing — collecting credentials, financial information, or other sensitive data through deception.
  • Identity theft or impersonation of another person, organization, or public figure.
  • Pyramid schemes, multi-level marketing presented as educational content, or get-rich-quick schemes.
  • Misinformation or disinformation designed to cause harm or that a reasonable person would find dangerously misleading.

Malware and Security Threats

  • Malware, ransomware, spyware, viruses, or any malicious software.
  • Content designed to exploit, compromise, or gain unauthorized access to systems, accounts, or data.
  • Distribution of hacking tools intended for use against systems you do not own or have explicit permission to test.

Illegal Goods and Services

  • Sale, purchase, or facilitation of illegal drugs or controlled substances.
  • Unlicensed sale of weapons, firearms, ammunition, or related accessories.
  • Sale or promotion of any good or service that is illegal in the jurisdiction where it is offered or received.
  • Gambling in jurisdictions where it is prohibited by law.
  • Money laundering, structuring, or any financial activity that conceals the source or destination of funds.

Spam and Platform Abuse

  • Sending unsolicited bulk messages, spam, or promotional content to other users.
  • Creating fake accounts, purchasing engagement, or artificially inflating enrollment or follower counts.
  • Using automated tools to interact with the Platform in ways that violate these terms.
  • Scraping Platform content without authorization.

3. Educational Content — Safe Harbor

Portfol.io is an educational platform. Discussion of sensitive, difficult, or controversial topics is often necessary for genuine learning. The following types of content are permitted when presented for legitimate educational purposes:

  • Historical discussion of atrocities, wars, or extremist movements for the purpose of education or analysis.
  • Medical, anatomical, or health-related instruction that includes clinical depictions of the human body.
  • Legal, financial, or policy discussion of regulated industries (including drugs, gambling, and weapons) in an academic context.
  • Cybersecurity instruction, including discussion of vulnerability classes and defensive techniques, provided the content is oriented toward defense and not exploitation.
  • Political commentary, debate, and criticism of public figures and institutions.
  • Discussion of hate speech or extremist ideology for the purpose of counter-extremism education, journalism, or research.

The distinguishing factor is intent and presentation. Content that analyzes or critiques prohibited activity for educational gain is different from content that promotes, facilitates, or glorifies it. We reserve the right to make this determination on a case-by-case basis.

4. Enforcement

Portfol.io takes policy violations seriously. When we determine that a violation has occurred — or may have occurred — we may take any of the following actions, at our sole discretion:

  • Remove or restrict access to violating content.
  • Issue a warning to the account holder.
  • Temporarily suspend the account.
  • Permanently terminate the account and revoke all associated access.
  • Withhold pending payouts where required by law or where funds are linked to prohibited activity.
  • Report content or activity to law enforcement, regulatory bodies, or relevant industry organizations (including NCMEC for CSAM).
  • Cooperate fully with law enforcement investigations upon receipt of valid legal process.

Repeat violations, or a single severe violation involving illegal content, CSAM, terrorism, or fraud, will result in permanent removal from the Platform with no right of reinstatement. Portfol.io is not obligated to provide advance notice before taking action where doing so would interfere with an investigation or cause further harm.

Enforcement decisions may be appealed by contacting support@portfol.io. We will review appeals in good faith but are not required to restore accounts or content found to be in violation of this AUP.

5. Reporting Violations

If you encounter content or behavior on Portfol.io that you believe violates this AUP, please report it to us at support@portfol.io with the following information:

  • A description of the content or behavior you believe violates this policy.
  • The URL or location on the Platform where the content can be found.
  • Your name and contact information (optional, but helpful for follow-up).
  • If you are a rights holder reporting infringement, a description of the right you believe has been violated.

We review all reports and will take appropriate action consistent with this AUP. We are unable to share the outcome of enforcement actions with third-party reporters due to user privacy considerations, but all reports are taken seriously.

For copyright infringement claims specifically, please refer to the DMCA provisions in our Terms of Service.

6. Moderation

Portfol.io currently relies on user reports and manual review by our team to identify and respond to policy violations. We do not currently operate automated content moderation systems.

We may in the future implement additional tools — including automated systems — to help detect violations at scale. We will update this policy if and when such systems are deployed. We will not claim capabilities we do not have, and we will not make enforcement decisions based solely on automated outputs without human review for significant actions such as account termination.

7. Changes to This Policy

We may update this AUP from time to time to reflect changes in the law, our services, or our enforcement practices. When we make material changes, we will update the effective date at the top of this page. Continued use of Portfol.io after changes take effect constitutes acceptance of the updated policy.
